Resumo
[Resumen] La persona responsable por los daños derivados de los accidentes marítimos es
–generalmente- el naviero del buque o buques culpables, entendiendo por naviero la
persona que, directamente o a través de sus dependientes, tiene la posesión de un buque
o embarcación y lo dedica a la navegación en su propio nombre y bajo su responsabilidad.
Por lo tanto, debe concurrir, además de otros de otros requisitos, una relación de
dependencia entre el causante del daño y el naviero si se pretende atribuir la responsabilidad
a dicho naviero. El propósito de este trabajo es clarificar los términos “relación
de dependencia”, en relación con la seguridad de la navegación. [Abstract] The person responsible for the damage derived from accidents at sea is –generally-
the shipowner of the guilty ship or ships, being the shipowner the person who
directly or by means of his dependents has the possession of a ship or vessels and gives
it over to navigation on his own behalf and under his responsibility. Then, there must
be, among other requirements, a dependent relationship between the damage originator
and the shipowner if we want to attribute the liability to this shipowner. The purpose
of this work is to clarify the terms “dependent relationship”, in relation with the
safety of navigation.
