Algunas precisiones en punto al histórico distanciamiento entre los órganos jurisdiccionales y la ciudadanía: la positiva experiencia anglosajona

Abstract

[Resumen] El presente trabajo aborda, desde una perspectiva histórica y del derecho comparado, las razones que han originado y mantenido el divorcio existente en España entre la ciudadanía y la judicatura y trata de solucionar el problema sobre la base de la positiva experiencia anglosajona. Comienza con una exposición de las notas características del “Common Law”, refiriéndose muy especialmente al elemento laico a través del jurado y al lenguaje oral de los intervinientes en el litigio y, posteriormente, lo compara con la situación española pasada y presente. Por último, concluye proponiendo una serie de soluciones para aproximar los ciudadanos a la administración de justicia.

[Abstract] The present work approach,from a historical point of view and of comparative law, the reasons that maked and maintained the existing divorce at Spain between the citizenship and the judicature and tries to resolve this problem in base to the positive anglosaxon experience. It starts whit the exposition of the “Common´s Law”basis, stopping very specially respect to the laic element trough the jury and the oral expression of the people who mediates in the trial and,then, makes a comparation with the spanish situation in the past and in the present. Finally, concludes purposing one order of solutions for to close the citizens to the judicial administration.
