dc.description.abstract | [Resumen] La teoría de los contratos innominados constituye una de las más interesantes y notables muestras del genio jurídico romano, y además de representar la última etapa del desarrollo del contrato romano como fuente de obligaciones, se encuentra en dicha teoría el principio que ha ejercido mayor influencia en la elaboración de preceptos fundamenta- les de todos los derechos modernos, de hecho, indicar el nacimiento de la obligatoriedad civil de los contratos innominados es uno de los problemas más difíciles de resolver y más controvertido en el estudio del Derecho romano. También analizamos la evolución del principio de la autonomomía privada y de la libertad contractual -la libertad de iniciativa y de determinación del contenido de los negocios jurídicos- en el Derecho Romano, siem- pre en relación a los nova negotia, y su recepción en el Derecho actual, además de la tute- la procesal a través de la actio praescriptis verbis, y la posible analogía justinianea con los contratos reales, al constituir ambos fuente de obligaciones ex re tradita. | es_ES |
dc.description.abstract | [Abstract] THE CIVIL REGOGNITION OF INNOMINATE CONTRACTS The theory of innominate contracts constitutes one of the most interesting and outstanding examples of Roman legal genius. Moreover, as well as representing the final stage of the development of the Roman contract as a source of obligations, the principle of this theory has exercised the greatest influence in the creation of the fun- damental precepts of all modern legal systems. The origin of the civil legal obligation of innominate contracts is one of the most controversial and difficult to resolve pro- blems in the study of Roman law. This work also analyses the development of the prin- ciple of private autonomy and freedom of contract-the freedom of initiative and deter- mination of the contents of juridical acts- in Roman law, in connection with nova nego- tia. This work also discusses its reception in present day law as well as procedural pro- tection through action praescriptus verbis, and the possible Justinian analogy with con- tracts in general, as both constitute a source of binding obligations ex re tradita. | es_ES |
