Desplazamientos temporales en el marco de una prestación de servicios transnacional

Abstract

[Resumen] Este trabajo tiene como objetivo investigar acerca de los desplazamientos temporales en el marco de una prestación de servicios transnacional, una realidad de la sociedad globalizada, que viene planteando diversas cuestiones en matera de reconocimientos de condiciones de trabajo en igualdad, dentro del gran mercado de trabajo que supone la Unión Europea. Se analiza la Directiva 96/71/CE y su trasposición a la regulación española a través de la Ley 45/1999. La libre circulación de personas reconocida en el Tratado de Funcionamiento de la Unión Europea representa una necesidad de protección necesaria de las condiciones de trabajo de los trabajadores transnacionales, para que se lleven a cabo bajo principios de no discriminación, y de igualdad. En primer lugar, se contextualiza y se estudia la regulación de la situación legal en la Unión Europea y en España, así como, las normativas de desarrollo. También, se analiza las últimas reformas operadas en España y como inciden en el movimiento transnacional de trabajadores, lo cual es el objetivo principal del trabajo. Las nuevas normativas plantean nuevas cuestiones en diferentes materias como son el transporte, el dumping social, las empresas de trabajo temporal o la contratación o subcontratación de trabajadores. Por último, analizaremos algunas sentencias del TJUE en torno a las condiciones de trabajo de los transnacionales.

[Abstract] The aim of this work is to investigate the issue of temporary employment in the framework of a transnational provision of services, a reality of the globalised society, which has raised various questions regarding the recognition of equal working conditions within the large labour market of the European Union. An analysis is made of Directive 96/71/EC and its transposition into Spanish regulations through Law 45/1999. The free movement of persons recognised in the Treaty on the Functioning of the European Union represents a need for the necessary protection of the working conditions of transnational workers, so that they can be carried out under principles of non-discrimination and equality. Firstly, the regulation of the legal situation in the European Union and in Spain is contextualised and studied, as well as the implementing regulations. It also analyses the latest reforms in Spain and how they affect the transnational movement of workers, which is the main objective of the work. The new regulations raise new issues in different areas such as transport, social dumping, temporary employment agencies and the contracting or subcontracting of workers. Finally, we will analyse some rulings of the CJEU on the working conditions of transnationals.
