Resumo
[Resumo] A Constituição Federal Brasileira de 1988 marca a redemocratização do país,
após mais de 20 anos do autoritarismo da Ditadura Militar (1964-1988). O ideal do
legislador constituinte foi a fundação de uma social-democracia nos moldes europeus,
com respeito aos direitos humanos, justiça social, e voltada para o desenvolvimento
econômico. No entanto, existe uma grande distância entre esse ideal e a realidade social.
De fato, os direitos e garantias fundamentais são amplamente violados em meio à crescente
onda de violência e criminalidade que assola o país nos últimos anos. Além disso,
o desenvolvimento econômico foi pequeno nos últimos 20 anos e grande parte da população
continua pobre e sem educação, com poucas perspectivas de ascensão social. Essa
situação tem sido descrita como falta de força normativa da Constituição, que enfraquece
o sistema jurídico brasileiro como um todo, dando lugar à “lei do mais forte”.
Esse problema tem sido debatido no meio acadêmico brasileiro, a partir da teoria dos
sistemas sociais. Com base nessa teoria, tem-se analisado como o sistema constitucional
brasileiro tem evoluído num meio ambiente social altamente complexo, em que a
concretização do sistema jurídico é constantemente bloqueada pela expansão destrutiva
da força, seja econômica, seja política. Estaria o Brasil passando por mais uma fase de
alternância entre autoritarismo e “redemocratização”, que caracterizou a América
Latina no século XX? O objetivo deste artigo é analisar a evolução constitucional brasileira
nessas primeiras duas décadas de vigência da Constituição Federal à luz da teoria
dos sistemas. [Abstract] The Brazilian Federal Constitution of 1988 marks the redemocratization that
took place after 20 years of authoritarianism under the Military Dictatorship (1964-
1988). The ideal of the constitutional legislator was to found a social democracy in the
European way, with respect for human rights, social justice and directed towards economic
development. Nevertheless, there is a great distance between this ideal and social reality. As a matter of fact, the basic rights of citizens are widely violated amid a rampant
wave of violence and criminality that sweeps the country in the last years.
Moreover, economic growth has been tiny in the last 20 years and a big part of the population
remains poor and uneducated, with small expectation of social advancement. This
situation has been described as a lack of normative force of the Constitution, which weakens
the Brazilian juridical system as a whole, giving place to the “rule of the stronger”.
The Theory of Social Systems has been used as a point of departure to this debate in
Brazil. It has been analysed how the Brazilian constitutional system has evolved amidst
a highly complex social environment, in which the effectiveness of juridical system is
constantly impaired by the destructive expansion of force, either economic or political.
Is Brazil going through another moment of alternation between authoritarianism and
redemocratization, which characterized Latin America in the 20th Century? The purpose
of this essay is to analyse the evolution of the Brazilian Constitution in the two first
decades of its coming into force in the light of the systems theory.
