Una aproximación a la terminología jurídica actual desde la perspectiva romanística

Abstract

[Resumen] En este trabajo esbozamos los principales problemas que afectan a la terminología jurídica. El lenguaje del derecho comparte con el resto de ciencias sociales muchos de sus problemas terminológicos, sin embargo, en el mundo del derecho, éstos se agravan a causa de su doble naturaleza: disciplina científica y técnica de regulación social. Entendemos que los rasgos carácterístico del lenguaje jurídico actual tienen su origen en la concepción romana del derecho. El derecho, como cualquier otra disciplina requiere de especialistas dedicados al análisis de la propia terminología, creemos que ésta sigue siendo una línea de investigación de especial interés para la romanística en el panorama jurídico europeo actual, globalizado y plurilingüe.

[Abstract] In this work I outline the main problems that affect the legal terminology. The language of the law shares with the rest of social sciences many of its terminological problems, however in the field of the law, these problems get worse because of a double nature of the law: scientific and technical discipline of social regulation. The characteristics of the current legal language have their origin in the Roman conception of the law. The law, as any other discipline, requires of specialists dedicated to the analysis of the own terminology and this topic continues to be a line of research of key interest for the roman law studies in the current European globalized and multilingual legal panorama.
