dc.description.abstract[Resumo] Este comentario faise sobre unha recente sentenza do Tribunal Constitucional, ditada o 10 de outubro de 2013, que resolve o recurso de amparo dunha traballadora fora cesada, sen alegación de causa, durante o período de proba do seu contrato estando embarazada. A xurisdición laboral desestimou a súa reclamación, ao entender que no período de proba o cesamento é libre para os empresarios, criterio confirmado polo Alto Tribunal, que o xustificou na ausencia de calquera indicio discriminatorio. Así e todo, esta sentenza contou con dous importantes votos particulares discrepantes, porque nos supostos dos despedimentos das traballadoras embarazadas debe distinguirse se a decisión empresarial responde ao embarazo ou se simplemente coincide no tempo.
dc.description.abstract[Abstract] This comment is made about a recent ruling of the Spanish Constitutional Court, on October 10th, 2013, that resolves the appeal of a woman was ceased during her pregnancy, without allegation of cause, during the trial of her contract. The labour courts dismissed his claim, to understand that the end during trial is –for the employer– free, confirming this criterion the Court, justifying it in the absence of any indication of discriminatory, but with two important divergent particular, because in the event of the dismissal of pregnant employees it must be distinguished if the business decision responds to pregnancy or if it simply coincides in time.
