Derecho del trabajo y crisis económica. La 'Reforma laboral Rajoy' del derecho individual del trabajo

Abstract

[Resumen] Este trabajo analiza el impacto del Real Decreto-ley 3/2012 sobre las principales estructuras sustantivas (y también, adjetivas) de nuestro Derecho individual del Trabajo. Se centra en el estudio del nuevo contrato de trabajo indefinido para emprendedores, de la reforma del régimen de la modificación objetiva del contrato de trabajo y, por último, de la reforma de los despidos objetivos, colectivos y disciplinarios. Concluye con una crítica de la reforma operada por esta norma, razonando que la finalidad de la legislación laboral es proteger al trabajador, pero no crear directamente empleo por sí misma.

[Abstract] This paper analyzes the impact of the Royal Decree-act 3/2012 on the main substantive (and also, procedure) structures of our Employment Law. It is focused on the study of the new indefinite contract of employment to entrepeneurs, on the reform of the regime of the objective modification of the contract of employment, and lastly, on the reform of the objective, collective, and disciplinary dismissals. It concludes with a criticism of the changes performed by this norm, foundating that the aim of the labor legislation is to protect the workers, but not to directly create employment by itself.
