Proxección da xurisprudencia constitucionalñ sobre a participación de suxeitos privados na xestión da actividade de seguridad social

Abstract

[Resumo] O traballo aborda a cuestión do significado da «seguridade social» no artigo 41 da Constitucióne a súa incidencia na xestión da seguridade social polos suxeitos privados, tratando de descubrir o título xurídico en virtude do cal reciben esa competencia e a natureza das súas actividades, coas consecuencias que se poidan derivar de todo iso. Con este propósito analízase a doutrina do Tribunal Constitucional que se referiu a esta materia e as sentenzas do Tribunal Supremo que estudan o exercicio de funcións públicas por suxeitos privados.

[Abstract] The work done talks about the meaning of the «social security» in article 41 of the Constitutionand the impact this has on the management of social security private individuals, trying to figure out the legal title under which they receive such functions and the nature of its activities,with consequences that may arise from this. For this purpose, we analyze the doctrine of the Constitutional Court which has referred to this matter and the judgments of the SupremeCourt who study the exercise of public functions by private individuals.
