Los caracteres del acto administrativo y el efecto suspensivo de los recursos administrativos

Abstract

[Resumen] El trabajo analiza críticamente la tesis que afirma que la fuerza ejecutoria del acto administrativo impide que la interposición de los recursos suspendan su ejecución y efectos. Se argumenta que esta tesis importa un enunciado dogmático ya que no existe ninguna relación (conceptual, lógica ni axiológica) necesaria entre los caracteres del acto y aquel efecto suspensivo. Se cuestionan los fundamentos esgrimidos para sostener tal efecto (la supuesta paralización de la administración) y se plantea, en definitiva, la conveniencia de revisar la regla del art. 12 de la ley de procedimientos administrativos

[Abstract] This work critically analyses the proposition which maintains that the enforceability (i.e., the executory character) of the administrative act impedes and prevents the lodging of administrative reviews or appeals from suspending its execution and effects. It is argued that such proposition embodies a dogmatic premise as there exists no necessary connection (whether conceptual, logical or axiological) between the attributes of the administrative act or decision and the aforementioned suspensive effect. The grounds put forward to support such effect (the alleged paralyzing of public administration activity) are questioned, and the convenience of reviewing the rule set forth by section 12 of the Administrative Procedures Act is stated and proposed
