Abstract
[Resumen]: En el presente trabajo nos centraremos en la utilización de los sistemas de inteligencia artificial como elementos a utilizar en la valoración de los datos fácticos del proceso penal. Es decir, nos centraremos en las aplicaciones que permiten a través del análisis de macrodatos, extraer conclusiones que sirven para avanzar en la investigación penal o que verifiquen los presupuestos fácticos del proceso, como diligencias de investigación o de prueba, según la forma de introducir estas herramientas en el proceso y de la finalidad pretendida en cada ocasión. Más concretamente, nos centraremos en los problemas que plantea la comprobación de licitud de la prueba obtenida a través de mecanismos de inteligencia artificial y el desafío que supone para la capacidad judicial de análisis sobre los presupuestos de licitud de la prueba y el respeto a los derechos fundamentales en su obtención
[Abstract]: In this paper we will focus on the use of artificial intelligence systems as elements to be used in the assessment of factual data in criminal proceedings. That is, we will focus on the applications that allow, through the analysis of big data, to extract conclusions that serve to advance the criminal investigation or to verify the factual assumptions of the process, as investigative or evidentiary steps, depending on how these tools are introduced in the process and the intended purpose on each occasion. More specifically, we will focus on the problems posed by the verification of the lawfulness of the evidence obtained through artificial intelligence mechanisms and the challenge it poses for the judicial capacity of analysis on the assumptions of lawfulness of the evidence and the respect for fundamental rights in its collection.
