Sin embargo, el poder legislativo español no ha realizado los cambios normativos oportunos para dar efectividad a la doctrina Čakarević. En esta situación, el poder judicial ha sido el encargado de aplicarla. La Sentencia 92/2006, de 28 de enero, de la Sala de lo Social del Tribunal Supremo, explica la doctrina Čakarević, y recopila los casos en que se ha aplicado.[Abstract]: The Čakarević ruling by the European Court of Human Rights, which establishes limits on the repayment of unduly received social security benefits, has brought about a fundamental shift in Spanish social security law. However, the Spanish legislature has not made the necessary regulatory changes to give effect to the Čakarević doctrine. In this situation, the judiciary has been responsible for its application.
