[Resumen] La Ley Orgánica 3/2021 de regulación de la eutanasia es fruto de los debates sobre cuidados al final de la vida y muerte digna en el Parlamento español. Una forma de evaluar la corrección de esta ley es analizar los argumentos utilizados en los debates legislativos. El presente capítulo emprende dicho análisis desde una doble perspectiva: en primer lugar, examinando la racionalidad de esos argumentos y, en segundo lugar, examinando qué modelos de debate dieron forma a la discusión parlamentaria del proyecto de ley. Conocer los motivos a favor y en contra de esta ley y cómo los han argumentado los legisladores ofrece pautas para comprender la tarea parlamentaria, interpretar la ley y reforzar las garantías jurídicas para sus destinatarios. Además, permite caracterizar la argumentación parlamentaria como un sistema deliberativo y también permite sugerir mejoras para futuros procesos legislativos.
[Resumo] A Lei orgánica 3/2021 de regulación da eutanasia é o resultado dos debates sobre coidados ao final da vida e morte digna no Parlamento español. Unha forma de valorar a corrección desta lei é analizar os argumentos empregados nos debates lexislativos. O presente capítulo realiza esa análise dende unha dobre perspectiva: en primeiro lugar, examinando a racionalidade deses argumentos e, en segundo lugar, examinando que modelos de debate conformaron a discusión parlamentaria do proxecto de lei. Coñecer as razóns a favor e en contra desta lei e como as argumentaron os lexisladores ofrece pautas para entender o quefacer parlamentario, interpretar a lei e reforzar as garantías legais para os seus destinatarios. Ademais, permite caracterizar a argumentación parlamentaria como un sistema deliberativo e tamén permite suxerir melloras para futuros procesos lexislativos.
[Abstract] The Organic Law 3/2021 on the regulation of euthanasia is the result of the debates on end-of-life care and death with dignity in the Spanish Parliament. One way to assess the correctness of this law is to analyse the arguments used in the legislative debates. The present chapter undertakes such an analysis from a twofold perspective: firstly, by examining the rationality of those arguments, and secondly, by examining what models of debate shaped the parliamentary discussion of the bill. Knowing the reasons for and against this law and how the legislators have argued them offers guidelines for understanding the parliamentary task, interpreting the law and reinforcing the legal guarantees for its addressees. Furthermore, it allows the parliamentary argumentation to be characterised as a deliberative system and also allows the suggestion of improvements for future legislative processes.
