Abstract
[Resumen] El presente trabajo aborda el contenido del Asunto Heinrich, donde el Tribunal
de Justicia de las Comunidades Europeas deja sin fuerza vinculante una parte del
Reglamento nº 622/2003, de la Comisión, por el que se establecen las medidas para la
aplicación de las normas comunes sobre la seguridad aérea. La problemática planteada
alrededor de la Sentencia C-345/06, demuestra que la transparencia y la publicidad no
son siempre principios fáciles de armonizar en la práctica política y jurídica de la Unión
Europea.
[Abstract] The aim of this work is to analyze the Heinrich case, in which the Court of Justice of European Communities declares that the annex to the Commission Regulation no. 622/2003, laying down measures for the implementation of the com- mon basic standards on aviation security, has no binding force. The topic of C-345/06 sentence shows that transparency and publicity cannot be easily harmonized in the political and legal practice of the European Union.
