Objetivos de conservación y coherencia global de la Red Natura 2000

Abstract

[Resumen] Los objetivos de conservación son un elemento esencial de la Red Natura 2000, a pesar de que la propia Directiva Hábitats no los define ni obliga a su adopción por parte de los Estados miembros. No obstante, la Comisión Europea y el Tribunal de Justicia de la Unión Europea han venido entendiendo que estos objetivos serán los que habrá que tener en cuenta para determinar si un plan o proyecto puede afectar de forma apreciable a un lugar de la Red y, por lo tanto, deberá someterse a una evaluación ambiental adecuada. Además, si se realiza esta evaluación, será el impacto sobre estos objetivos el que supondrá el resultado positivo o negativo de la misma. Estos objetivos se enmarcan, además, en el contexto de consecución global de un estado de conservación favorable y la coherencia global de la Red.

[Abstract] Conservation objectives are an essential element of the Natura 2000 Network, although the Habitats Directive itself does not define them or require their adoption by the Member States. However, the European Commission and the Court of Justice of the European Union have understood that these objectives will be the ones to be taken into account to determine whether a plan or project is likely to significantly affect a site in the Network and, therefore, must be subject to an appropriate environmental assessment. Furthermore, if such an assessment is carried out, it will be the impact on these objectives that will determine the positive or negative outcome of the assessment. These objectives are also framed in the context of the overall achievement of a favourable conservation status and the overall coherence of the Network.
