Abstract
[Resumen] Este artículo explica los criterios que guían el ejercicio profesional. En concreto, qué significa y cómo funciona la lex artis, como la expresión jurídica de la buena práctica médica. Tras una introducción justificativa, ordeno las normas legales, jurisprudenciales y deontológicas de la lex artis para mostrar la transformación contemporánea de la relación clínica en dos sentidos: el equilibrio entre la libertad profesional y la autonomía y los derechos de los pacientes, y por otro lado la combinación de los aspectos científicos y técnicos con los elementos éticos, jurídicos y deontológicos. Este contexto normativo da paso a la tesis central: la lex artis es un estándar, esto es, un tipo de norma que no exige un resultado ni indica qué se debe hacer, sino que prescribe cómo debería actuar el profesional: un ejercicio diligente, prudente y razonable que ha definirse en cada caso y en cada paciente. Por consiguiente, la lex artis es un saber cómo, que ratifica que el ejercicio profesional y el razonamiento médico siguen siendo ejemplos de sabiduría práctica.
[Abstract] This paper tries to explain the criteria that guide professional practice. Specifically, what does lex artis mean and how does it work, as the legal expression of good medical practice.After a justifying introduction, I order the legal, case-law and deontological norms of lex artis in order to show the contemporary shift of clinical relationship in two senses; the balance between professional freedom and patient’s autonomy and rights, and the combination of scientific and technical aspects with ethical and legal elements. This normative context introduces the central thesis: lex artis is a standard, that is, a type of norm that neither requires a result nor indicates what should be done, but rather prescribes how the healthcare professional should act; a diligent, prudential and reasonable practice that must be defined case by case, patient by patient. Therefore, lex artis is a knowing-how and confirms that healthcare practice and reasoning remain examples of practical wisdom.
