Análisis de la forma de aparición del delito de denuncia falsa (art. 456 CP) a través de una muestra jurisprudencial (2010-2019)

Abstract

[Resumen] Este trabajo examina más de doscientas sentencias condenatorias por un delito del art. 456 del CP, sistematizándolas en función del delito denunciado, el género de denunciante y denunciado y la relación entre ambos. Las conclusiones permiten intuir que la perspectiva de género puede ser de ayuda para entender las dinámicas comisivas del mencionado delito.

[Abstract] In this paper, the author analyzesthe dynamics of the crime of false allegation (§456 of the Spanish Penal Code). The methodology consisted of examining more than two hundred convictions, and systematizing them according to the crime reported, the gender of the complainant and the accused, and the relationship between both of them. The results allow us to conclude that the gender perspective can be helpful to understand the dynamics of the crime of false allegations.
