Abstract
[Resumen] El artículo trata de la posición jurídica de la Administración en la contratación
administrativa. En concreto, se analizan las diferentes prerrogativas que acompañan a
la Administración pública en la reciente ley española de contratos del sector público,
como la potestad de modificar los contratos, el privilegio de la interpretación unilateral
o la resolución unilateral. Se dedica una especial referencia a la jurisprudencia del
Tribunal Supremo Español en la materia y una aproximación al concepto de interés
general como elemento central del Derecho Administrativo.
[Abstract] This article deals with the legal position of the government as far as administra- tive contracts are concerned. The various different powers and prerrogatives which accompany the government’s position in the recent law about public sector contracts are analysed. Special attention is paid to those prerrogatives with a unilateral interpretation, those involving changes in contract conditions, those enabling unilateral resolution and those related to management. Special reference is made to the Crown Court’s jurispru- dence related to the matter in hand and to a functional perspective of the concept of gen- eral interest.
