Abstract
[Resumen]: La discriminación encuentra en nuestro ordenamiento jurídico-laboral un
amplio abanico de normas proscribiéndola, y los mecanismos necesarios para hacer efectiva
esa prohibición son múltiples y variados. Así, existen tanto procedimientos judiciales
como extrajudiciales instaurados con la finalidad exigir el cumplimiento de tales
obligaciones normativas. Entre estos últimos merecen especial atención los convenios
colectivos y la Inspección de Trabajo. Por lo que se refiere al ámbito judicial, la normativa
adjetiva laboral contiene un específico procedimiento judicial de tutela, así como artificios procesales creados con el fin de imponer un régimen probatorio favorable a la parte
demandante.
[Abstract]: Discrimination finds in our legal-labour system a wide range of regulations proscribing it, and the mechanisms necessary to make this prohibition effective are multiple and varied. Thus, there are both judicial and extrajudicial procedures established in order to demand compliance with such regulatory obligations. Among the latter, collective agreements and the Labour Inspection deserve special attention. With regard to the judicial sphere, the adjective labor regulations contain a specific legal guardianship procedure, as well as procedural devices created in order to impose a favorable evidentiary regime on the plaintiff.
