Abstract
[Resumen] Uno de los principales problemas que ha de afrontar el intérprete constitucional
actual es la determinación del contenido constitucional de los derechos fundamentales.
La tarea no se presenta sencilla si se toma en consideración que las fórmulas lingüísticas
empleadas para su reconocimiento por el constituyente español son generales e
imprecisas. Sin embargo, el intérprete constitucional cuenta con una serie de herramientas,
y una de ellas es precisamente las determinaciones jurídicas que el Tribunal
Europeo de Derechos Humanos ha realizado sobre los derechos reconocidos en la
Convención Europeo de Derechos Humanos. Los criterios de interpretación formulados
por el Alto Tribunal Internacional constituyen una fuente de determinación del contenido
constitucional de los derechos fundamentales para los tribunales nacionales españoles,
dando así paso al fenómeno conocido como internacionalización de los derechos
fundamentales. En el presente artículo se muestra como se ha producido este fenómeno
en la jurisdicción del Tribunal Constitucional español.
[Abstract] One of the main problems the current constitutional interpreter has to face is related with the determination of the constitutional content of the fundamental rights. The task is not an easy one if we take in consideration that the linguistic methods used by the Spanish constitutional law maker are general and not precise. Nevertheless, the constitutional interpreter has a few tools, one of them are the legal determinations of the European Court of Human Rights have done about the fundamental rights recognised in the European Convention of Human Rights. The understanding criteria developed by this High International Tribunal become a source to establish the constitutional content of the fundamental rights for the Spanish national tribunals, promoting in this way the phenomenon know as the internationalization of the fundamental rights. In the present article we show how such a phenomenon has been done in the jurisdiction of the Spanish Constitutional Court.
