Abstract
[Resumen] La Ley de Medidas de Protección Integral contra la Violencia de Género ha
aportado, como bien es sabido, un nuevo marco legislativo para el abordaje integral de la
violencia de género en la pareja. Muchos aspectos de la Ley han sido aplaudidos por los
feminismos y las activistas por los derechos de las mujeres. Sin embargo, la Ley ha sido
fuertemente criticada respecto al recurso tan central que su articulado recoge, y que ha
sido aún más evidente en su desarrollo, al sistema penal. En este sentido, se ha criticado
intensamente que los derechos que reconoce la Ley a las mujeres que han sobrevivido a la
violencia machista en la pareja se hagan depender de la obtención de una orden de protección.
Este artículo recoge los resultados de la investigación “Los centros de acogida para mujeres
que han sobrevivido a la violencia machista dentro de la pareja. Estudio comparado entre las
ciudades de Bilbao, Sevilla y Barcelona” que ha realizado el Observatorio del Sistema Penal
y los Derechos Humanos respecto del papel que la denuncia penal tiene para acceder a los
mencionados recursos en las ciudades citadas
[Abstract] As it is well known, the Law of Measures of Integral protection against Gender Violence has contributed a new legislative framework to the integral approach to gender violence in the couple. Many aspects of the law have been welcomed by feminisms and activists for women’s rights. However, the law has been strongly criticized regarding to the resort, so central in its articles, but even more evident in its development, to penal system. In this sense, it has been intensely criticized because rights recognized to women who have survived to sexist violence in the couple are conditioned to obtaining a protection order. This article gathers the results of the research called “Refugees for women who have survived gender violence in the couple. Comparative study among Bilbao, Seville and Barcelona” carried out by the Observatory of Penal System and Human Rights regarding the role of penal complaint in accessing to these refugees in the mentioned cities
