[Resumo] A navegabilidade ou inavegabilidade do navio tem considerável relevo nas
Regras de Haia no âmbito da identificação de causas de responsabilidade do transportador
marítimo. Este texto começa por abordar os sentidos em que a navegabilidade
deve ser entendida, ocupando-se em seguida do momento a partir do qual o
dever de diligência recai sobre o transportador e da inaplicabilidade das causas de
exclusão de responsabilidade que o art. 4.º, 2, das Regras de Haia enumera. Posteriormente,
o autor volta a atenção para os desafios que as novas tecnologias colocam
à forma como a navegabilidade do navio é concebida, sendo depois lançado
um olhar sobre os danos indemnizáveis.
[Abstract] The seaworthiness or unseaworthiness of the ship is of considerable importance in the Hague Rules in what concerns identifying the causes of liability of the maritime carrier. This text addresses the meanings in which seaworthiness should be understood, deals with the moment from which the duty of care falls on the carrier and with the inapplicability of the causes of exclusion of liability that Article 4(2) of the Hague Rules lists. The author then turns his attention to the challenges that new technologies pose to the way in which the seaworthiness of ships is conceived and then looks at compensable damages.
