<<Interpretatio prudentium>> y <<ius controversum>>: a propósito de la regulación de la adpoción y la autotutela en la Ley 2/2006, de 14 de Junio, de Derecho Civil de Galicia

Abstract

[Resumen]: A partir de la doctrinalmente discutida fundamentación jurídica seguida por el Tribunal Constitucional en su STC 133/2017, de 16 de noviembre, por la que se resuelve el recurso de inconstitucionalidad interpuesto por el Presidente del Gobierno respecto a los arts. 27 a 45 de la Ley del Parlamento de Galicia 2/2006, de 14 de junio, de Derecho civil de Galicia, se pretenden analizar algunas cuestiones relativas a la forma y al fondo argumentativo de la interpretación realizada sobre diversos aspectos conectados con el posible desarrollo institucional del Derecho civil de Galicia.[Abstract]: On the grounds of the legal basis adopted by the Constitutional Court, in its judgement 133/2017, of 17 September decinding on an action of unconstitutionality against articles 27 to 45 of the Gallician Civil Law Act 2/2006, of 14 June, this paper aims at analysing some fundamental issues relating to the line of arguments adopted by the Court with respect to several aspects linked to institutional development of the Gallician Civil Law.
