Abstract
[Resumen]: Mientras que la pensión de jubilación del Régimen General es plenamente compatible con la pensión de viudedad del propio Régimen General (con el único límite de la pensión máxima), la pensión de jubilación SOVI tiene un régimen de compatibilidad más es¬tricto con la pensión de viudedad del Régimen General. Supuesto que la pensión de jubilación SOVI la perciben mayoritariamente mujeres, en tanto que la pensión de jubilación del Régimen General la perciben mayoritariamente hombres, se produce una situación de discriminación indirecta por razón de sexo, que provoca una brecha de género de seguridad social. Dada la limitada eficacia de una eventual solución judicial, habría que intervenir legislativamente para eliminar dicha brecha
[Abstract]: While the retirement pension under the General Regime is fully compati¬ble with the widow’s pension under the same General Regime (with the only limit being the maximum pension), the SOVI retirement pension has a stricter compatibility regime with the widow’s pension under the General Regime. Given that the SOVI retirement pension is mainly received by women, while the General Regime retirement pension is mainly received by men, a situation of indirect discrimination on the basis of sex arises, which leads to a gender gap in social security. Given the limited effectiveness of a possible judicial solution, it would be neces¬sary to intervene legislatively to eliminate this gap
