La responsabilidad del práctico: Cuestiones pendientes

[Resumen] Pese a su antigüedad, el régimen jurídico del practicaje sigue planteando muchas dudas. En buena medida ello se debe a que el legislador no tiene clara ni su naturaleza jurídica ni la manera de delimitar las respectivas responsabilidades del capitán del buque y del práctico del puerto. Estos problemas se agudizan en el marco actual, por la falta de un concepto preciso y comúnmente aceptado del “servicio público”, y por la aparición de nuevas realidades, como el buque autónomo, que requerirán un nuevo planteamiento de la cuestión, sobre bases diferentes[Abstract] Despite its age, the legal regime for pilotage continues to raise many problematic issues. To a large extent, this is due to the fact that the law-maker is not clear about its legal nature or about the rules applicable to the delimitation of the respective responsibilities of the ship’s captain and the port pilot. These problems are exacerbated in the current framework, due to the lack of a precise and commonly accepted concept of “public service”, and due to the appearance of new realities, such as the autonomous ship, which will require a new approach to the issue, on different bases.
