Gestión sostenible de residuos en Portugal: un análisis de la responsabilidad ampliada del productor

Abstract

[Resumen] La economía circular, impulsada por la Unión Europea (UE) desde 2015, ha redefinido la gestión de productos y residuos, dejando atrás el enfoque lineal en el que los productos se desechan después de su vida útil. La legislación de la UE, con un énfasis en la Responsabilidad Ampliada del Productor (RAP), ha sido fundamental en esta transición. La RAP extiende la responsabilidad del productor hasta el final del ciclo de vida del producto, alentando la reutilización, el reciclaje y la reducción del impacto ambiental. Portugal se ha sumado a este esfuerzo y ha adaptado su marco legal, incorporando la RAP y ajustándolo a las directrices de la UE. En este contexto, el objetivo principal de esta investigación es analizar la configuración de la RAP en la legislación portuguesa, especialmente después de las últimas modificaciones legislativas de la UE. La investigación se divide en varios epígrafes, comenzando con un análisis del marco legal de la RAP en la UE y luego explorando su implementación en Portugal, con un enfoque en los sistemas integrados de gestión. Finaliza con reflexiones y recomendaciones para avanzar hacia una gestión de residuos más sostenible y eficiente en Portugal.

[Abstract] The circular economy, driven by the European Union (EU) since 2015, has redefined the management of products and waste, leaving behind the linear approach where products are discarded after their useful life. EU legislation, with an emphasis on Extended Producer Responsibility (EPR), has been pivotal in this transition. EPR extends the producer's responsibility to the end of the product's life cycle, encouraging reuse, recycling, and reducing environmental impact. Portugal has joined this effort and adapted its legal framework, incorporating EPR into the General Waste Management Regime and aligning it with EU guidelines. In this context, the main objective of this research is to analyze the configuration of EPR in Portuguese legislation, especially after the latest EU legislative changes. The research is divided into several sections, starting with an analysis of the legal framework of EPR in the EU and then exploring its implementation in Portugal, with a focus on integrated management systems. It concludes with reflections and recommendations to move towards more sustainable and efficient waste management in Portugal.
