Abstract
[Resumen] En el presente artículo se analiza la legislación española sobre las vacunas y la salud pública y la incidencia de la pandemia en este ámbito, en el que la normativa existente resulta a todas luces insuficiente, con especial análisis de la reforma operada en la Ley de Salud de Galicia que establece la vacunación obligatoria, la imposición de sanciones e incluso el uso de la fuerza para hacerla efectiva. Por último, se examinan las normas aplicables en el caso de personas con discapacidad, que no puedan decidir libremente sobre la vacunación y el consentimiento por sustitución, así como el procedimiento jurídico a través del cual deberán solventarse los supuestos de negativa de sus representantes legales o familiares.
[Abstract] This article focusses on Spanish the regulatory framework on vaccination administration as well as its implications in the Health Care system. This framework does not seem to be fully satisfactory given the impact of current events, such as the COVID-19 global pandemic. In this regard, this paper reviews the recent regulations adopted within the Galician Health Law. The new precepts stablish fines or even law enforcement in order to ensure its compliance. This paper explores the application of these regulations in the disability community and its implications when individuals are unable to make an informed decision and therefore consent by proxy is required. Finally, the article also shows what court procedures can be followed when facing family members or legal guardian refusal to accept treatment.
