Abstract
[Resumen]: En este artículo se analiza la pena de disolución de los partidos
políticos declarados responsables de la comisión de delitos por sus
dirigentes y mandos intermedios. Tras analizar los cambios de opinión
del legislador respecto de la posibilidad de exigir responsabilidad penal
a los partidos, se estudian con detalle los presupuestos de aplicación
y las consecuencias de la pena de disolución, así como la eventual
evitación de dicha responsabilidad a través de la adopción de medidas
eficaces de prevención de delitos. El objetivo es poner de manifiesto
la incompatibilidad de que la pena de disolución pueda ser impuesta
por cualquier juez o tribunal simplemente en casos de reincidencia
cualificada con la relevante función constitucional que desempeñan los
partidos políticos en la democracia española.
[Abstract]: This paper analyses the penalty of dissolution of political parties declared responsible for committing crimes by their leaders and middle management. After analysing the changes of opinion of the legislator regarding the possibility of demanding that parties be criminally liable, we will examine in detail the cost and consequences of implementing the penalty of dissolution, as well as the potential avoidance of such liability through the adoption of effective crime preventing measures. The aim is to show how incompatible it is that the penalty of dissolution may be imposed by any judge or court simply in cases of applicable recidivism with the relevant constitutional function undertaken by the political parties in Spanish democracy.
