Olvidada en el ángulo oscuro… ¿Qué fue de la deferencia al legislador?

Abstract

[Resumen]: La deferencia al legislador compartió íntima trayectoria con el principio de observancia de la ley durante un tiempo. Pero, ahora, ha quedado oculta en un rincón, como testigo de un tiempo en que el parlamento tenía la palabra, aunque no siempre fuese la última. A la ley todavía se la respeta; al legislador no. Se examinan algunas de las causas de ese divorcio y algunas de sus consecuencias.

[Abstract]: Deference to the legislator went hand in hand with the principle of law enforcement for a long time. But now it has been relegated to the sidelines, a relic of a time when parliament had the final say, even if it was not always the last word. The law is still respected, but the legislator is not. This article examines some of the causes of this divorce and some of its consequences.
