Clérigos como tutores y curadores en época preconstantiniana

Abstract

[Resumen] El artículo tiene por finalidad analizar, particularmente en clave jurídica, la primera carta de Cipriano; en ella se menciona la prohibición establecida en un concilio anterior, de nombrar a los clérigos como tutores y curadores en un testamento y se aplican las sanciones eclesiásticas a un caso concreto. Se estudia también la eficacia de dicha prohibición en el ámbito de la legislación civil de su época así como las razones que pudieron llevar a la iglesia africana a establecer tal prohibición.[Abstract] The paper studies, above all juridically, the first Cyprian’s Epistulae. The letter contains the prohibition, established in a previous council, on appointing a presbyter as guardian or procurator in a testament. Also it is analyzed the effectiviness of the prohibition in the roman civil law at that time and the reasons that the African Church had presented to establish the ecclesiastical sanctions against the presbyter.
