Abstract
[Resumen] El Derecho de hoy en día intenta plantear todas sus prescripciones de cara a la Persona. Esto significa que sus mandatos no serán más vinculantes por el mero hecho de proceder de una autoridad de competencia reconocida, sino que lo será por ser manifestación de una exigencia de justicia que se formula en torno a la Persona. La plena realización de la Persona es la finalidad del sistema jurídico, particularmente del constitucional; esto significará que la plena y real vigencia de los derechos humanos está ordenada como fin a conseguir en la mayor medida de lo posible. Desde estas categorías jurídicas esenciales, se han de expresar herramientas de interpretación tanto formales como materiales, que permitan la construcción de decisiones justas que favorezcan real y plenamente su máxima realización posible.
[Abstract] Law nowadays tries to face all its prescriptions to the person. Such a thing means that, law rules will not be binding just for the fact to come from a recognized competent authority, but they will be because they are an expression of justice shaped around the concept of human being. The complete realization of the person is the legal system’s aim, particularly the constitutional system. That will indicate that, the full and real fulfillment of human rights is conceived as a priority goal. From these essential legal categories, formal and material interpretation tools should be developed, to allow the construction of fair decisions that encourage a real and complete realization.
