Abstract
[Abstract]: Several amendments to Spanish Law of Criminal Procedure (LECrim) adopted prior to 1988 assigned both investigative and decision-making authority to investigative judges as to minor offences. This situation was declared to be incompatible with both the Spanish Constitution and European Convention on Human Rights by the Spanish Constitutional Court. Therefore, a new amendment was needed that would both enshrine judicial impartiality and provide for minor offences to be processed promptly. This was the aim of Organic Act 7/1988, which established the abbreviated proceeding (Procedimiento abreviado).
