Abstract

[Abstract]: The chapter gathers together some of the findings of the RePers project in relation to possible improvements in the implementation of Framework Decision 2008/909/JHA, particularly in light of the Italian, Romanian and Spanish experiences and perspectives. The analysis addresses the main phases of the cross-border transfer procedure, from the identification of the potential transferee to the decision on recognition and the possible overlap with other procedures, such as the European Arrest Warrant.

[Resumen]: El capítulo recoge algunas de las conclusiones del proyecto RePers en relación con las posibles mejoras en la aplicación de la Decisión Marco 2008/909/JAI, en particular a la luz de las experiencias y perspectivas italianas, rumanas y españolas. El análisis aborda las principales fases del procedimiento de traslado transfronterizo, desde la identificación del posible cesionario hasta la decisión sobre el reconocimiento y el posible solapamiento con otros procedimientos, como la orden de detención europea.
