Abstract
[Resumen]: La libertad de la persona a la hora de configurar sus relaciones jurídicas y las situaciones
a las que se llega como consecuencia de las mismas han experimentado un notable
impulso en los últimos años llegando a alcanzar ámbitos hasta hace relativamente poco
impenetrables. En el presente estudio se lleva a cabo una reinterpretación de la normativa
de la ausencia desde la perspectiva de la reforma operada por la Ley 8/2021. A nuestro
juicio los nuevos paradigmas instaurados en el Código civil para garantizar la igualdad
de derechos de la persona con discapacidad en el ejercicio de su capacidad jurídica tienen
mayor trascendencia que la inicialmente se preveía siendo una buena prueba de ello el
contenido de este trabajo.
[Abstract]: The freedom of individuals to shape their legal relationships and the situations that arise as a result of them, have experienced a significant boost in recent years, reaching areas that were impenetrable until relatively recently. In the present study, a reinterpretation of the absence regulation is carried out from the perspective of the reform brought into operation last year. In our opinion, the new paradigms established in the Civil Code to guarantee the equal rights of persons with disabilities in the exercise of their legal capacity have greater importance than initially foreseen, and the content of this work is a good example of this.
