Los principios generales en el Derecho Administrativo venezolano

Abstract

[Resumen] Los Principios generales del Derecho no son solo el origen o la base del sistema jurídico. “Principium is primum”, decían los escolásticos; ello implica que los Principios representan y funcionan como instrumento eficiente para la adecuada selec- ción y aplicación de la solución jurídica procedente al caso concreto, pero también actú- an como una referencia permanente y regular para evaluar la conducta de los órganos del poder público, en contraste con valores primordiales de la sociedad, tales como la libertad y la democracia. El artículo ofrece una revisión teórica del asunto, junto a una revisión sobre algunos de los aspectos que el tema presenta en la realidad práctica actual, en Venezuela.

[Abstract] The Principles of Law are not only the beagining or the origin of the rule system. “Principium is primum”, as escolastics use to say, means that they represent and work as an efficient instrument for the correct selection and application of the raight solution of conflict, but also, they act as an standard and permament reference to evaluate the government behaivor, in order to know the respect for social values, such as liberty and democracy. The essay intends a theorical review of the cuestion, checking, at the same time, some of the more important items of the situation in Venezuela, today.
