Abstract
[Resumen] El artículo contiene unas notas críticas sobre la regulación del patrimonio fami-
liar gallego. Se consideran aspectos positivos de la ley la regulación de la legitima de
los descendientes, limitada al 25 % de la herencia testamentaria del causante, así como
el usufructo de la viuda y los pactos sucesorios. Como aspectos negativos se considera
innecesaria y contraria a la actual realidad económica la extensión de antiguas institu-
ciones como la mejora de labrar y poseer, o el lugar acasarado, a “la explotación agri-
cola, industrial, comercial o fabril”, que son las que hoy tienen verdadera importancia.
Se critican también algunos errores técnicos jurídicos como llamar “propietarios sin
usufructo” a los que siempre se denominaron “nudos propietarios”.
[Abstract] This paper offers some critical remarks to the new law passed in the Spanish Autonomous Community of Galicia for the regulation of the family patrimony. As posi- tiv aspects of the law, the author includes the regulation of the reserved portion in favor of the descendants, which is restricted to the 25% of the full inheritance, as well as the widow usufruct and other hereditary agreements. Nevertheless, some aspects of the law should be openly underlined as negative, in the author’s opinion, such as the mention of some old socioeconomic institutions like the “improvement of farming or having the land” or the “lugar acasarado”, instead of other up-to-date expressions as, for instance, agricultural, industrial, manufacturing of trade explotation, which are more consistent with the present vocabulary. The author takes also into account some errors in the legal terminology, such as naming “owners without usufruct” to those always called “remain- dermen”.
