El aforismo «venire contra factum proprium nulli conceditur» y el artículo 597 del código civil español

Abstract

[Resumen]: Análisis, en atención a la doctrina de los propios actos y sus precedentes romanos, del fundamento histórico-jurídico del deber de no impedir por parte del copropietario concedente el ejercicio del derecho de servidumbre concedido de forma individual y separada sobre fundo en condominio cuando los demás comuneros no hubiesen cedido todavía el mismo, establecido en el artículo 597 del Código civil español.

[Abstract]: The main purpose of this paper is to analyse, putting attention to the principle of own acts and its roman precedents, the legal and historical basis of the duty not to prevent the exercise of the right of way granted, individually and separatelly, on the field in condominium by the co-owner, when the rest of co-owners have not yet ceded it, according to the article 597 of the Spanish Civil Code.
