Abstract
[Resumen] El presente artículo estudia el fenómeno del nuevo constitucionalismo producto de revoluciones de derechos y fortalecimiento del poder judicial en diversos países a finales del siglo pasado y principios del presente, con el objeto de plantear interrogantes respecto a si estos cambios son resultado de un verdadero desarrollo de la ciencia jurídico-constitucional o si implican sólo una especie de tecnocracia jurídica al servicio de élites políticas.
[Abstract] This article studies the phenomenon of the new constitutionalism product of rights revolutions and strengthening of the judiciary in various countries at the end of the last century and beginning of the present, in order to raise questions about whether these changes are the result of a true development of legal-constitutional science or if they involve only a kind of legal technocracy at the service of political elites.
