Abstract
[Resumen] La Ley 5/2025 modifica dos conceptos normativos clave en orden a determinar cuándo nos encontramos ante un evento dañoso susceptible de ser sometido al régimen aplicable a la responsabilidad civil y seguro en la circulación de vehículos a motor: vehículo a motor y hecho de la circulación. En ambos casos se amplia objetivamente el ámbito de aplicación del referido régimen jurídico, de conformidad con el Derecho derivado de la UE y la jurisprudencia del TJUE. El legislador ha aprovechado la necesidad de transponer laDirectiva (UE) 2021/2118 para introducir otras reformas en este mismo ámbito normativo, en particular en el baremo de daños corporales y en otras cuestiones adyacente como el seguro de los vehículos ligeros de movilidad personal. La Ley 5/2025 también introduce ligeras modificaciones en el seguro de vida de las personas con discapacidad.
[Abstract] Law 5/2025 introduces significant amendments to two fundamental legal concepts in determining the scope of civil liability and compulsory motor insurance: the definition of “motor vehicle” and the notion of “use of a vehicle in traffic”. In both respects, the reform broadens the material scope of application of the regime, aligning national law with EU secondary legislation and the jurisprudence of the Court of Justice of the European Union (CJEU). The transposition of Directive (EU) 2021/2118 has also been used as an opportunity to implement further adjustments in the same regulatory field, notably with regard to the scale for the assessment of bodily injury damages, as well as ancillary issues such as insurance coverage for light personal mobility vehicles. In addition, Law 5/2025 introduces minor amendments concerning life insurance for persons with disabilities.
