Abstract
[Resumen:] En este artículo científico se quiere exponer de una manera completa las situaciones
–y consecuencias a ello anudadas- en que se puede encontrar una trabajadora embarazada cuando
el empresario decide extinguir el contrato de trabajo, ya sea durante el periodo de prueba, ya sea
posteriormente. En el análisis de los supuestos de hecho, se remarcará los elementos que el Legislador
español ha diseñado para proteger el hecho biológico del embarazo frente a la decisión del empleador
y, también, la profunda carencia que sigue persistiendo.
[Abstract]: In this scientific article is to expose situations –and their consequences - in that you can find a pregnant employee when the employer decides to extinguish the contract of employment, during the trial period, either later. In the analysis of the factual circumstances, highlighted what the Spanish Legislator has designed to protect the biological fact of pregnancy against the employer’s decision, and also deep gap which is still persisting.
