[Resumen] Al hilo de dos normas, una proyectada -el Anteproyecto de Reforma del Texto
Refundido de la Ley de Puertos del Estado y de la Marina Mercante- y otra
publicada recientemente, la Ley 4/2022, de 25 de febrero, de protección de
consumidores y usuarios frente situaciones de vulnerabilidad social y económica
(BOE nº 51, de 1 de marzo de 2022), se analizan dos cuestiones de amplio calado en
la estiba portuaria. Me refiero, por un lado, al régimen de limitación de
responsabilidad de los empresarios de manipulación portuaria y, por otro, la
transformación de las Sociedades Anónimas de Gestión de Estibadores Portuarios,
en Centros Portuarios de Empleo, para dar cumplimento a las recomendaciones de la
Unión Europea en materia de libertad de establecimiento, por lo que aquí hace al
caso: de las empresas estibadoras que deseen establecerse en puertos españoles
[Abstract] In line with two regulations, one projected -the Draft Reform of the Consolidated Text of the Law on State Ports and the Merchant Marine- and another recently published, Law 4/2022, of February 25, on the protection of consumers and users facing situations of social and economic vulnerability (BOE nº 51, of March 1, 2022), two issues of wide significance in port stowage are analyzed. I am referring, on the one hand, to the regime limiting the liability of port handling companies and, on the other, the transformation of the Port Stevedore Management Corporations into Port Employment Centers, in order to comply with the recommendations of the European Union in terms of freedom of establishment, as regards the case here: stevedoring companies wishing to establish themselves in Spanish ports.
