[Resumen]: Se ha intentado demostrar en este capítulo que la doctrina de aplicación de oficio de la norma imperativa de consumo construida en las dos últimas décadas por el TJUE no contraviene los principios fundamentales del proceso civil español ni el derecho constitucional a un juicio justo. Al contrario, esta jurisprudencia y las consecuencias que de ella se derivan sirven para dar cumplimiento a un objetivo de política legislativa con relevancia constitucional: la protección a las personas consumidoras
[Abstract]: This chapter has sought to demonstrate that the doctrine of ex officio application of mandatory consumer law, developed by the Court of Justice of the European Union over the last two decades, does not contravene the fundamental principles of Spanish civil procedure or the constitutional right to a fair trial. On the contrary, this case-law and the consequences arising from it serve to fulfil a legislative policy objective of constitutional significance: the protection of consumers
