El paisaje marítimo en el derecho actual y en el romano tardío: una aproximación comparativa

Abstract

[Resumen] La presente contribución científica tiene como finalidad avalar la idea de que ya el Derecho Romano tardío mostró interés en la protección y gestión de los paisajes marítimos, integrándolos en los planeamientos urbanísticos, mediante disposiciones originales y creativas que, en realidad, parecen nacidas de las legislaciones más actuales. Para lograr nuestro objetivo, comenzamos analizando cierta normativa internacional paradigmática, para pasar después a comentar la normativa española con incidencia en los paisajes a nivel estatal, dejando para otra ocasión las normativas promulgadas en las Comunidades Autónomas o las ordenanzas municipales más significativas.

[Abstract] The purpose of this scientific contribution is to support the idea that late Roman Law already showed interest in the protection and management of maritime landscapes, integrating them into urban planning, through original and creative provisions that, in reality, seem to have been born from the most current legislation. In order to achieve our objective, we begin by analyzing certain paradigmatic international regulations, and then move on to comment on Spanish regulations with an impact on landscapes at the state level, leaving for another occasion the regulations enacted in the Autonomous Communities or significant municipal ordinances.
