Abstract
[Abstract] The purpose of this paper is to analyse the compatibility of the procedure leading to mutual recognition of criminal judgments relating to probation measures with the right of victims of gender-based violence to participate in the penal execution. To this end, I identify which probation measures and alternative sanctions may be subject to mutual recognition in the field of gender-based violence. I also pay attention to the importance given to the objective of victim protection in Framework Decision 947. The study of the right to participate in the penal execution phase, recognised to the victim during the issuance, enforcement and revocation of the mutual recognition decision, whether under European or national law, leads to the conclusion that greater coordination between legal instruments is needed if the victim is to be truly protected.
