Los golpes bajos de la Unión Europea a la Carta Social Europea

Abstract

[Resumen]: Al hilo del acierto innegable de una afirmación del Profesor VALDÉS DAL-RÉ, se analiza aquí —siempre en un marco contextual asentado en lo que debe entenderse por la Europa de los Derechos Humanos— la relación que ha querido tener la Unión Europea con la Carta Social Europea y con la interpretación y aplicación de la misma por parte del Comité Europeo de Derechos Sociales, a través de la actividad de control que implica tanto el sistema de informes por parte de los Estados como el sistema de reclamaciones colectivas. Este análisis permite comprobar la distinta forma que han tenido la Unión Europea y el Comité Europeo de Derechos Sociales para conciliar los derechos sociales y las libertades económicas, pero también para poner de relieve el hecho de que la Unión Europea, a pesar de sus declaraciones sobre la importancia de la Carta Social Europea, se ha querido apartar del contenido de la misma, haciéndolo incluso de forma hipócrita y desleal. Por todo ello, es lógica y comprensible la postura de quienes defienden la necesidad de que la Unión Europea deba adherirse a la Carta Social Europea para lograr así una convivencia armoniosa entre el Derecho de la Unión Europea y el Derecho del Consejo de Europa en el ámbito de los derechos sociales.

[Abstract]: In line with the undeniable wisdom of a statement by Professor VALDÉS DAL-RÉ, the relationship that the European Union has sought to have with the European Social Charter and with the interpretation and application of the same by the European Committee of Social Rights, through the monitoring activity that involves both the system of reports by the States and the system of collective complaints, is analysed here, always within a contextual framework based on what should be understood by the Europe of Human Rights. This analysis shows the different ways in which the European Union and the European Committee of Social Rights have reconciled social rights and economic freedoms, but also highlights the fact that the European Union, despite its declarations on the importance of the European Social Charter, has wanted to deviate from the content of the Charter, even in a hypocritical and disloyal manner. The position of those who advocate the need for the European Union to accede to the European Social Charter in order to achieve a harmonious coexistence between European Union law and Council of Europe law on social rights is therefore logical and understandable.
