Abstract
[Resumen] La Propuesta de Directiva sobre medios de pago representa un avance en la unificación
del régimen contractual de los medios de pago y de la responsabilidad derivada
de este servicio. La contratación del servicio se somete a obligaciones de transparencia
destinadas a proteger la clientela (no necesariamente consumidora pero sí necesitada de
información adicional en consideración a la complejidad del servicio). La responsabilidad
puede analizarse desde la perspectiva del cumplimiento del contrato marco de emisión
y de las órdenes de pago, pero también como una daño patrimonial derivado de un
servicio defectuoso que no puede controlar plenamente su uso fraudulento por terceros.
[Abstract] The Proposal for a Directive of the European Parliament and of the Council on payment services in the internal market will allow an improvement in harmonizing the legal framework for payments and the liability deriving from those services. The payment service contract must fulfill some rules established in order to ensure transparency of conditions and to protect customers (not necessary a consumer, but deserving additional information because the complexity of the service). We can analyze the liability with regard to compliance with the framework contract and payment orders, and with regard to the patrimonial damages caused by defective services, that are not able to avoid fraud.
