Tres modelos legislativos de la pornografía

Abstract

[Resumen] En este trabajo vamos a clasificar los modelos normativos que se han desarrollado en distintos países en materia de pornografía, trazando una analogía con la conocida división de los modelos jurídicos de la prostitución (prohibicionista, abolicionista y liberal). La finalidad de este ensayo es facilitar la reflexión acerca de los paradigmas teóricos que subyacen tras las alternativas normativas y encaminarnos así hacia aquellas medidas que sean consistentes con la agenda abolicionista en materia de pornografía. El abolicionismo sostiene que tanto la prostitución como la pornografía forman parte de una industria construida sobre la explotación y la vejación de las mujeres. Es necesario acoger un modelo legislativo abolicionista de la pornografía, que proteja los derechos de las mujeres.[Abstract] In this paper we classify the regulatory frameworks that have been developed in different countries in the subject of pornography, trying to draw an analogy with the well-known division of the legal frameworks for prostitution (prohibitionist, abolitionist and liberal). The aim of the study is to offer insight into the theoretical paradigms underlying the different regulations and move towards those policies that are consistent with the abolitionist agenda in relation to pornography. Abolitionism argues that prostitution and pornography are both part of an industry that has been built on the exploitation and abuse of women. An abolitionist legislative framework that protects women's rights must be embraced.
