Abstract
[Resumen] La finalidad de este artículo es estudiar detalladamente la proyección histórica,
desde el derecho romano hasta el vigente código civil español, de los actos de disposi-
ción jurídica de la cosa común por uno solo de los copropietarios. En especial, la aten-
ción se centra en el supuesto de la venta de una cosa común por un único copropietario.
Se trata, en definitiva, de una modalidad cualificada de venta de cosa ajena.
[Abstract] The aim of this article is to perform a detailed study of the historic trajectory, from Roman Law up to the Spanish Civil Code that is currently in force, of legal pro- ceedings transferring property held in common by only one of the co-owners. Attention especially centres on the circumstances surrounding the sale of jointly owned property by only one co-owner. It is, in short, a specific form of the sale of property belonging to another.
