La protección de un núcleo rural por red natura y la posibilidad de su normal aprovechamiento: un ejemplo de urbanismo sostenible

Abstract

[Resumen] La oportunidad de compatibilizar la actual delimitación de Red Natura con una ordenación urbanística respetuosa con el derecho de propiedad se impone en los núcleos rurales gallegos por razones de conservación como garantía de calidad de vida y desarrollo de la persona, haciendo compatible el ejercicio de dicho derecho con los límites de sostenibilidad impuestos por el Ordenamiento jurídico vigente. La existencia de unas realidades sociales, de núcleos de población conformados y de usos urbanos constatados determinan la aplicación de un régimen jurídico singular a dichas zonas distinto al que se derivaría de una inercia en la aplicación de la ley por la especial protección derivada de la Red Natura. Se trata, sin desnaturalizar la vinculación sectorial otorgada por tal afectación, de delimitar el contenido del derecho de propiedad en dichos ámbitos a través de Planes Especiales de Protección y Conservación, atendiendo a razones temporales, sociales, económicas y ambientales y con la finalidad de lograr una ordenación integral de los núcleos de poblaciones afectados por Red Natura.[Abstract] The opportunity to assure that the current delimitation of the Natura Network is consistent with a concept of city planning respectful of the right of property should be imposed in Galician rural areas due to conservation issues as a guarantee of a high standard of living and personal development, so as to make compatible the exercise of said right and the sustainability limits imposed by the current Legal System. The existence of different social realities, shaped centres of population and verified urban usages determines the application of a specific Legal Framework in these areas, different from the one that would be applied out of habit, thanks to the special protection provided by the Natura Network. The matter in question is, while trying not to distort the sectorial entailmentgranted by said affectation, to delimit the content of the right of property in said areas through Special Protection and Conservation Plans, in view of temporal, social, economical and environmental reasons and with the purpose of achieving an integral planning of centres of population affected by the Natura Network.
