Abstract
[Resumen] La Directiva relativa a determinados aspectos de la ordenación del tiempo de trabajo define el tiempo de trabajo y los períodos de descanso como conceptos mutuamente excluyentes, lo que plantea la cuestión de calificar como tiempo de trabajo o período de descanso aquellas situaciones en donde la persona trabajadora no trabaja efectivamente, pero sí está a disposición de la empresa (guardias, retenes). La Sentencia comentada, al hilo de un caso concreto de compleja calificación, sienta interesantes criterios generales.
[Abstract] The Directive concerning certain aspects of the organization of working time defines working time and rest periods as exclusive concepts, which raises the question of qualifying as working time or rest periods those situations in which the worker does not works effectively, but is available to the Company (on call time). The commented Judgment, in line with a specific case of complex qualification, establishes interesting general criteria.
